Terms of Service (AuctFlow)

Welcome to AuctFlow. These Terms of Service govern your access to and use of our website, platform, and services. By using AuctFlow, requesting a demo, or creating an account, you agree to these Terms.

If you do not agree, you may not use AuctFlow.

1. About AuctFlow

AuctFlow is a software platform designed to help auction businesses manage auctions, lots, bidders, and related workflows in a modern and structured way.

AuctFlow may provide services to:

  • Auction companies and organizations (business customers)

  • Users and bidders who participate in auctions hosted on the platform

2. Definitions

In these Terms:

  • AuctFlow, we, us, our refers to AuctFlow.

  • Customer means the organization or business that subscribes to or uses AuctFlow.

  • User means any person accessing the platform, including admins and bidders.

  • Platform means the AuctFlow software, dashboard, and related services.

  • Content includes any data uploaded, created, or managed through AuctFlow, such as auctions, lots, descriptions, images, and bidder information.

3. Eligibility and account use

To use AuctFlow, you must:

  • Be at least 18 years old, or have permission from a legal guardian

  • Provide accurate and complete information when registering or submitting forms

  • Keep your login credentials secure

You are responsible for all activity under your account. If you suspect unauthorized access, you must notify us as soon as possible.

4. Platform access and availability

We aim to provide a reliable platform, but we do not guarantee uninterrupted access at all times. AuctFlow may be temporarily unavailable due to:

  • Maintenance

  • Updates

  • Technical issues

  • External service disruptions

We may improve, modify, or change features at any time to maintain quality and performance.

5. Customer responsibilities

Customers using AuctFlow agree to:

  • Use the platform in a lawful and professional manner

  • Ensure that all auction and bidder activity complies with applicable laws and regulations

  • Keep auction data accurate and up to date

  • Handle bidder data responsibly, including providing required notices and policies

Customers remain responsible for the auctions they publish and manage through AuctFlow.

6. Bidder and user responsibilities

Users and bidders agree to:

  • Provide correct information where required

  • Not attempt to abuse the platform or interfere with auctions

  • Not use the platform for fraudulent or illegal purposes

  • Respect auction rules and conditions set by the auction organizer

AuctFlow is not responsible for auction outcomes, disputes, or agreements between bidders and auction organizers.

7. Acceptable use policy

You may not use AuctFlow to:

  • Upload harmful, unlawful, misleading, or offensive content

  • Send spam or unwanted messages

  • Attempt unauthorized access to accounts or systems

  • Reverse engineer, copy, or exploit the platform

  • Disrupt platform performance or security

We may suspend or terminate access if we believe there is misuse, risk, or violation of these Terms.

8. Content and ownership

You retain ownership of the content you upload or create within AuctFlow.

By using the platform, you grant AuctFlow a limited license to host, process, display, and use your content only for the purpose of operating and improving the platform.

AuctFlow retains ownership of:

  • The platform software

  • Branding and design elements

  • Documentation and underlying technology

9. Communication and email notifications

AuctFlow may send operational emails such as:

  • Account verification

  • Auction notifications

  • System updates

  • Security messages

Customers may be able to configure certain bidder communications. However, AuctFlow may still send essential emails required for platform security and account integrity.

10. Pricing, billing, and fees

If you subscribe to a paid plan, you agree to pay all fees associated with your selected plan.

Pricing may include:

  • Subscription fees

  • Setup fees

  • Commission based pricing (if applicable)

  • Additional services or custom work

Payment terms, billing frequency, and plan details will be presented before purchase or confirmed in writing.

We may adjust pricing or plan structures in the future. If changes affect active subscriptions, we will provide notice where reasonably possible.

11. Free trials and demos

AuctFlow may offer demos, previews, or trial access. These are provided for evaluation purposes and may include limitations.

We may end or modify trial access at any time.

12. Suspension and termination

We may suspend or terminate access to AuctFlow if:

  • You violate these Terms

  • There is suspicious activity or security risk

  • Required payments are overdue (for paid subscriptions)

  • We are required to do so by law

Customers may also cancel their subscription according to the agreed billing terms.

After termination, access to the platform may be removed, and content may be deleted according to our data retention practices.

13. Disclaimers

AuctFlow is provided “as is” and “as available.”

We do not guarantee that:

  • The platform will meet every specific business need

  • Auctions will result in any specific outcome

  • Errors will never occur

Auction organizers are responsible for ensuring that their auctions are fair, lawful, and correctly configured.

14. Limitation of liability

To the maximum extent permitted by law, AuctFlow is not liable for:

  • Indirect or consequential damages

  • Loss of profit, revenue, or business

  • Auction disputes between customers and bidders

  • Data loss caused by third party services or events outside our control

Our total liability is limited to the amount paid by the customer to AuctFlow in the relevant period, unless mandatory law requires otherwise.

15. Privacy and data protection

Our processing of personal data is described in our Privacy Policy.

Customers are responsible for ensuring they have the legal right to collect and process bidder data within AuctFlow, including providing required privacy information to bidders.

16. Changes to these Terms

We may update these Terms from time to time. Updates will be posted on this page with a revised date.

If changes are significant, we may provide additional notice.

17. Governing law

These Terms are governed by the laws of The Netherlands, unless mandatory consumer protection laws apply differently.

Any disputes will be submitted to the competent court in The Netherlands, unless otherwise required by law.
